Terms of Service

Last updated October 1, 2026

Effective date: October 5, 2026 Last updated: October 1, 2026 Terms version: 2026-10-01

1. Introduction and who we are

These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "user") and Harmonia LLC, a South Carolina limited liability company ("Seylen," "we," "us," or "our"), the provider of the Seylen mobile application and related services (together, the "Service"). "Seylen" is the brand and product name; Harmonia LLC is the legal entity that operates it.

The Service is offered from the United States and is intended for use only by residents of the United States. We make no representation that the Service is appropriate or available for use outside the United States.

By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy and Consumer Health Data Privacy Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

2. Acceptance of these Terms and eligibility

2.1 Acceptance. You accept these Terms when you tap or click to indicate agreement at sign-up (for example, "By continuing, you agree to our Terms of Service and Privacy Policy"), or when you otherwise access or use the Service. Your continued use of the Service after we post changes (see Section 18) means you accept the updated Terms.

2.2 You must be 18 or older. The Service is intended only for adults aged 18 and older. By creating an account and using the Service, you represent and warrant that you are at least 18 years of age. During onboarding you are asked to confirm this in writing ("I … confirm that I am 18 years of age or older"), and we record that confirmation. We do not knowingly collect information from, or provide the Service to, anyone under 18.

2.3 Authority. If you accept these Terms, you represent that you have the legal capacity to enter into this agreement.

3. Description of the Service

Seylen is an AI-powered, non-clinical emotional-wellness and self-reflection companion for otherwise-healthy adults navigating everyday stress — work pressure, relationships, low mood, and ordinary life transitions. The Service provides warm, reflective conversation, plain-language grounding, user-reported mood check-ins, and a memory of what you choose to share so that the experience feels continuous over time.

You are talking to artificial intelligence — not a human, and not a licensed professional. Every conversational response in the Service is generated by an AI system. Seylen is not staffed by therapists, counselors, doctors, or other licensed professionals, and no human reviews or participates in your conversations in real time. The app persistently identifies itself as "Your AI support" so that its nature is never ambiguous.

You can report any reply Seylen gives you, from inside the app, if you find it offensive or inappropriate. We read those reports (see the Privacy Policy). Beyond that, no person reads or takes part in your conversations as they happen.

We may add, change, or remove features of the Service at any time, and we may discontinue the Service. Not every feature is available on every platform or in every release.

4. Seylen is NOT medical or mental-health care

This section is fundamental. Please read it carefully. Your agreement to it is a condition of using the Service.

4.1 Not therapy, treatment, or diagnosis. Seylen is not therapy, counseling, psychotherapy, psychiatric care, medical care, diagnosis, or treatment of any kind. It does not diagnose, assess, screen for, treat, cure, prevent, or manage depression, anxiety, trauma, suicidality, addiction, eating disorders, personality disorders, or any medical, mental-health, or behavioral-health condition. It does not administer or imitate clinical assessments or validated clinical instruments, and it does not provide medical advice, medication guidance, dosing, or clinical recommendations.

4.2 Not a substitute for professional care. Seylen is not a substitute for professional medical or mental-health advice, diagnosis, or treatment. It is a general-wellness and emotional-support tool for everyday stress, offered for otherwise-healthy adults. Always seek the advice of a physician, licensed therapist, or other qualified health provider with any questions you have about a medical or mental-health condition. Never disregard professional advice, or delay seeking it, because of something you read or discussed in the Service.

4.3 Not a medical device. Seylen is a general-wellness product. It is not a medical device and is not intended to diagnose, treat, prevent, or mitigate any disease or condition. It has not been reviewed, approved, cleared, or registered by the U.S. Food and Drug Administration, and we make no claim that it has been.

4.4 No professional relationship. Using the Service does not create a therapist–client, physician–patient, or any other professional or fiduciary relationship between you and Seylen, and nothing in the Service should be understood as the practice of medicine, psychology, or counseling.

Two consequences follow, and we state them plainly rather than leave them to inference. Because no professional relationship is created, Seylen is not a HIPAA covered entity and is under no legal obligation to comply with HIPAA, and no doctor–patient, counselor–patient, or other professional confidentiality or privilege attaches to anything you tell Seylen. The security safeguards we do apply — and the limits of what we claim about them — are described in Section 12 and in our Privacy Policy.

5. Not for emergencies or crisis — how to get urgent help

5.1 The Service is not a crisis service. Seylen is not designed for emergencies, crisis intervention, or urgent mental-health support, and must not be relied upon for them.

5.2 In a crisis, contact emergency resources — not Seylen. If you or someone you know may be in danger, is thinking about self-harm or suicide, or is experiencing any emergency:

5.3 Crisis detection is a supportive referral feature, not a safety or monitoring service. The Service includes a feature that looks for certain crisis-related words and, when they appear, displays these same public resources (988, Crisis Text Line, 911). If the same conversation returns to it, the Service offers a wider set of routes — a chat option and a national helpline that can point you toward ongoing care — instead of repeating itself. The same feature also responds if you describe wanting to seriously harm another person: it declines to help with that and offers the same public resources. All of this is a fixed, best-effort referral prompt — not clinical monitoring, risk assessment, emergency dispatch, or a safety guarantee. It uses simple word-matching, is not a clinician, does not evaluate your actual risk, may miss or misread messages, and does not notify any person, emergency service, or third party on your behalf. A fuller public description of the feature is at https://seylenapp.com/crisis-protocol. You must not rely on the Service to detect, escalate, or respond to any emergency or crisis. Nothing about this feature makes Seylen responsible or legally liable for your safety, the safety of others, or for the detection of your need for professional help or crisis services.

6. AI limitations — please use good judgment

The Service is powered by artificial intelligence, and AI has real limitations you should understand:

7. Acceptable use

You agree to use the Service only for your own lawful, personal, non-commercial emotional-wellness purposes. You agree that you will not:

  1. Use the Service for or on behalf of anyone else, or input, upload, or process personal information about any other person without their permission.
  2. Rely on the Service for emergencies, crisis response, or any situation requiring urgent or professional help (see Section 5).
  3. Attempt to extract, expose, or reproduce Seylen's system prompts, instructions, model weights, or other underlying configuration, or to make the Service reveal them.
  4. Reverse-engineer, decompile, disassemble, scrape, or otherwise attempt to derive the source code, prompts, or underlying components of the Service, except to the limited extent this restriction is prohibited by applicable law.
  5. Attempt to jailbreak, circumvent, or defeat the Service's safety, scope, or content boundaries, or use the Service to generate, solicit, or advance harmful, illegal, hateful, abusive, or dangerous content.
  6. Use the Service in any unlawful manner, or to violate the rights of others.
  7. Interfere with or disrupt the Service or its infrastructure, including by transmitting malware, overloading, probing, or gaining or attempting to gain unauthorized access to any system, account, or data.
  8. Use any automated means (bots, scripts, scrapers) to access the Service, or resell, sublicense, or commercially exploit the Service or its content, except as we expressly permit.
  9. Impersonate any person or entity or misrepresent your affiliation.

We may investigate and take action — including suspending or terminating your access (Section 10) — for any suspected violation of this Section.

8. Subscriptions, free trial, and billing

The following terms apply to any subscription you purchase.

8.1 Plans and price. Seylen is a paid subscription, at $14.99 per month or $149.99 per year (in U.S. dollars, plus any applicable taxes). We may change prices going forward; any price change will not affect the term you have already paid for, and we will give advance notice as required by law before a change takes effect for you.

8.2 Free trial, card up front, and automatic conversion. New subscribers are offered a 14-day free trial. The trial is once per account: if you have used it before, subscribing again starts a paid subscription immediately, with no second trial. To start a trial, you must provide a valid payment method up front. Unless you cancel before the trial ends, your trial will automatically convert into a paid subscription and the payment method you provided will be charged the price of the plan you selected ($14.99/month or $149.99/year), and thereafter your subscription will automatically renew for successive periods of the same length at the then-current price until you cancel.

8.3 Cancel anytime; reminder before your first charge. You can cancel at any time, including during the free trial, to avoid the upcoming charge (see Section 9 for how). We will send you a reminder approximately two (2) days before your first charge so the conversion is never a surprise.

8.4 Payment processing — web only, via Stripe. Subscriptions are purchased and managed on the web, at seylenapp.com, through Stripe Checkout, our third-party payment processor. Payments are not processed as in-app purchases through the Apple App Store or Google Play, and the app hands you off to your browser to complete a purchase. Stripe handles your payment-card information under its own terms and privacy policy; we never receive or store your full card number. Your purchase is also subject to Stripe's terms.

8.5 Taxes. Prices are exclusive of taxes unless stated otherwise. You are responsible for any sales, use, or similar taxes, which may be added at checkout.

9. Cancellation and refunds

9.1 How to cancel. You may cancel your subscription at any time — from within the app, from the billing portal our payment processor hosts, or by contacting us at [email protected]. Cancellation stops the next renewal. To avoid being charged when a free trial converts, cancel before the trial period ends. We will make cancellation at least as easy as sign-up.

9.2 Effect of cancellation. When you cancel, you keep access to paid features through the end of the period you have already paid for, and your subscription will not renew after that.

9.2a Taking a break. The app also offers a "break," which is a cancellation described plainly: billing stops at the end of the period you have already paid for, and everything Seylen remembers about you is kept rather than deleted. There is no fixed length and nothing restarts on its own — when you come back, you choose a plan again at the price then in effect, which may not be the price you were paying. Taking a break does not hold or reserve your old price. You can delete your account at any point during a break without subscribing again.

9.2b Deleting your account stops billing. Deleting your account cancels any live subscription as part of the deletion. It is not a refund of amounts already charged (see §9.3).

9.3 Refunds. Except as required by applicable law, payments are non-refundable, and canceling does not entitle you to a refund of amounts already charged. The 14-day free trial and the reminder we send before your first charge are there so you can decide at no cost before any money changes hands. Nothing in this Section limits any non-waivable refund or cancellation right you have under the law of your state of residence.

10. Accounts and security

10.1 Your account. You need an account to use most of the Service. You agree to provide accurate information and to keep it current.

10.2 Your credentials. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Do not share your credentials. Notify us promptly at [email protected] if you suspect any unauthorized use of your account. We offer security features such as an in-app biometric lock; you are responsible for using the security tools available to you.

10.3 Our right to suspend or terminate. We may suspend, restrict, or terminate your account or access to the Service, with or without notice, if we reasonably believe you have violated these Terms (including Section 7), to protect the Service or other users, or as required by law. Where practical and lawful, we will give you notice. See Section 18 for the effects of termination.

11. Intellectual property and your content

11.1 Our property. The Service — including the Seylen app, its design, text, graphics, the "Seylen" name and marks, and the AI system prompts, instructions, prompt library, and content that power it — is owned by Harmonia LLC or its licensors and is protected by intellectual-property laws. Except for the limited license in Section 11.3, we grant you no rights in any of it.

11.2 Your content. As between you and us, you retain ownership of the content you submit to the Service (for example, the messages you write). You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and use your content to operate, provide, secure, and improve the Service — for example, to generate responses, maintain your memory and personalization, and keep the Service running — consistent with our Privacy Policy.

Using your content to improve the Service. Most of that use serves you directly. Two uses also help us improve the Service generally, and we describe them here rather than leave them to inference:

We do not train AI models on your conversations. Your content is not used to train, fine-tune, or otherwise build any general-purpose AI model. The AI that powers Seylen is self-hosted — your conversations are never sent to any third-party AI provider. We do not sell your content, and we do not share it with advertisers. Section 3 of our Privacy Policy describes all of these uses in full.

11.3 Your license to use the Service. Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Service for your own personal, non-commercial use. All rights not expressly granted are reserved.

11.4 Feedback. If you send us suggestions or feedback, you agree we may use them without restriction or obligation to you.

11.5 Third-party and open-source components. The Service includes third-party and open-source software, which remains the property of its respective owners and is used by us under its own license. Those components are provided "as is," without warranties; their authors and licensors are not parties to these Terms, have no responsibility for the Service, and make no warranties to you regarding it. The notices and license texts those components require are made available to you in the app, under Settings → About → Acknowledgements. Nothing about our use of third-party components changes what Section 12 says about your privacy: the AI that generates Seylen's replies runs on our own systems, so using it does not send your conversations to any outside AI provider.

12. Privacy and your health data

Your privacy matters. How we collect, use, protect, and share information is described in our Privacy Policy and, for consumer health data, our Consumer Health Data Privacy Policy (which addresses rights under the Washington My Health My Data Act and comparable state laws). By using the Service, you acknowledge those policies.

In summary, and as more fully described there: the AI that powers Seylen is self-hosted — your conversations are not sent to any third-party AI provider for processing; we do not sell your data or share it with advertisers, and the app contains no third-party advertising or analytics trackers; sensitive free-text content is encrypted at rest; and you can view what Seylen remembers and delete individual items or your entire account at any time.

Although we are not a HIPAA covered entity, we apply administrative, physical, and technical safeguards aligned with the HIPAA Security Rule's standards. We do not claim to be "HIPAA compliant," "HIPAA secure," or "HIPAA certified."

If these Terms and our privacy policies ever conflict, the privacy policies control. Where any conflict exists between anything in these Terms and the Privacy Policy or the Consumer Health Data Privacy Policy on how we collect, use, protect, share, retain, or disclose information, the Privacy Policy (and, for consumer health data, the Consumer Health Data Privacy Policy) governs and these Terms yield to it.

13. Disclaimers of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, error-free, or available at any particular time; that AI-generated content will be accurate, reliable, complete, or suitable for your situation; or that the Service will meet your needs. You use the Service, and rely on its content, at your own discretion and risk, and you remain responsible for your own decisions (Section 6).

Without limiting the above, we make no warranty and assume no responsibility for detecting, responding to, or preventing any emergency, crisis, or risk of harm (Section 5), and the Service is not a substitute for professional care (Section 4).

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you; in that case, such warranties are limited to the minimum extent permitted by law.

14. Limitation of liability

14.1 Exclusion of indirect damages. TO THE FULLEST EXTENT PERMITTED BY LAW, HARMONIA LLC AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14.2 Cap on total liability. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS (USD $100).

14.3 Basis of the bargain. These limitations are an essential part of the agreement between you and us and apply even if a limited remedy fails of its essential purpose.

14.4 State-law note. Some jurisdictions do not allow certain limitations or exclusions of liability; in those jurisdictions our liability is limited to the maximum extent permitted by law, and nothing in these Terms excludes liability that cannot be excluded by law.

15. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Harmonia LLC and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Service; (b) your violation of these Terms or of any law; or (c) your violation of the rights of any third party, including by inputting another person's information without permission. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate.

16. Dispute resolution; arbitration; class-action waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS HOW DISPUTES MAY BE RESOLVED.

We will first try to resolve any dispute informally — please contact us at [email protected] and give us a chance to make it right. If we cannot resolve it informally, the dispute will be handled by the courts identified in Section 17. We have not adopted mandatory arbitration.

To the maximum extent permitted by applicable law, you and Seylen agree that any dispute, claim, or controversy arising out of or relating to the Service, these Terms, or the relationship between you and Seylen (each, a "Dispute") will be resolved only on an individual basis and not in a class, collective, consolidated, representative, or private attorney general action (the "Class Action Waiver"). Accordingly, to the maximum extent permitted by applicable law:

16.1. Waiver of Class and Representative Proceedings. You and Seylen waive any right to have any Dispute brought, heard, administered, resolved, or arbitrated as a class, collective, consolidated, representative, or private attorney general action.

16.2. Individual Relief Only. Each party may bring claims against the other only in that party's individual capacity, and no Dispute will be joined or consolidated with any other proceeding involving any other person or entity.

16.3. No Class-Wide Relief. Unless prohibited by applicable law, the decision-maker (including an arbitrator, if arbitration applies) may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. The decision-maker may not award relief for, against, or on behalf of anyone who is not a party to the proceeding.

16.4. Severability / Survival. If any portion of this Class Action Waiver is found unenforceable as to a particular claim, cause of action, or requested remedy, then:

This Class Action Waiver survives termination of your relationship with Seylen and your use of the Service.

16.5. State-Law Limitations; Required Disclosures. NOTHING IN THIS CLASS ACTION WAIVER IS INTENDED OR SHALL BE INTERPRETED TO LIMIT RIGHTS THAT CANNOT BE WAIVED AS A MATTER OF LAW.

17. Governing law and venue

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. Subject to Section 16, the state and federal courts located in South Carolina will have exclusive jurisdiction, and you and we consent to personal jurisdiction there. Nothing in this Section limits any non-waivable rights or protections you have under the consumer-protection or health-privacy laws of your state of residence.

18. Termination; changes to these Terms; general provisions

18.1 Termination by you. You may stop using the Service and delete your account at any time from within the app. Deleting your account removes your data as described in the Privacy Policy (note that certain limited records, such as consent and security-audit logs, may be retained as described there).

18.2 Termination by us. We may suspend or terminate your access as described in Section 10.3.

18.3 Effect of termination. On termination, your license to use the Service ends. Sections that by their nature should survive — including Sections 4, 5, 6, 11 (ownership), 12, 13, 14, 15, 16, 17, and this Section — survive termination.

18.4 Changes to these Terms. We may update these Terms from time to time. If we make material changes, we will provide reasonable notice — for example, by posting the updated Terms with a new "Last updated" date and, where appropriate, by in-app notice or email — before they take effect. Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

18.5 Entire agreement. These Terms, together with the Privacy Policy and Consumer Health Data Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements on that subject.

18.6 Severability. If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force.

18.7 No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

18.8 Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets (for example, upon formation of the operating entity or a later reorganization).

18.9 Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.

18.10 Relationship to app-store terms. Your use of the Service may also be subject to the terms of the Apple App Store or Google Play; those terms are between you and the store. (Paid subscriptions are handled on the web via Stripe, not as in-app purchases — Section 8.4.)
